ELG successfully overturned a refusal by Hambleton District Council (Now North Yorkshire) for a single wind turbine. While acknowledging that the proposed turbine conflicted with the Local Plan the Inspector allowed the appeal having accepted that the benefits of the scheme were material considerations that outweighed the non-compliance with policy.
